In My Humble Opinion...

As a shareholder for more than 9 YEARS, I believe this brief is a good refresher course for anyone who was NOT in this from the beginning.

However, this court will not reverse the ruling of the previous court based on a restatement of the same information which resulted in the first two dismissals.
The case will again be dismissed after more briefs, replies, rebuttals from both sides, just like the last 2 years.

Yes, this case will be 2 YEARS old in a few weeks.

It will likely be 2 MORE YEARS before this gets ruled on by the Supreme Court...
And then, if we win the appeal in the Supreme Court, we will then just be at SQUARE ONE in the actual hearing of the actual facts of the case.

And then, no matter who wins or loses, the case will again be appealed all the way back to the Supreme Court...!!

So even if we do prevail, and someone finds all the double-secret trust funds holding our money, don't plan on seeing any of it any time 'soon'...!!

I'm guessing at least 4-5 MORE YEARS before this is settled either way.

I'm sure the gurus will all be saying there will be a settlement if any rulings go in our favor...

Don't hold your breath...!!

Hodges - CMKX - Inquiry 11-19090

I have been sending additional information to the California Bar Association, such as the updates & letters from Hodges & Associates being posted online.

I also advised them of the latest extension request for the appeal, in which Hodges swore under oath that a settlement was imminent.
Yet he is still sending letters to world figures begging them to release the settlement.

While the California Bar has assigned an official inquiry number to the complaint, I do not know if they have actually taken any action to investigate these activities.
They have not replied to my request for information about what steps if any, have been taken.

I know the wheels of justice move slowly, but it took them months to acknowledge my first email, and they replied by asking for additional information, which I had already provided.

I hope my complaint has not just been filed away and ignored.
Perhaps if more shareholders also filed complaints, the Bar may be convinced that they should actually investigate this matter.

Last night I sent him a Private Message on the board questioning his attack on Tuscan, and how he could have the nerve to complain about anyone else's posts 'getting old'...!!

This is from the person who has told us we're all done and getting paid soon, about once every week or two. Of course there are many examples, including his prediction of getting paid by the end of LAST YEAR, and that we wouldn't be shareholders in January...!!

I did not want to start a public riot, so I thought we could discuss it man to man in Private Messages...
Apparently, we were one man short of completing that equation.

Instead of addressing the repeated failures of his fluid information & predictions & guarantees, he ran to the admins like a 10 year old schoolboy, and had me banned from the board.

I have not posted anything on that board recently, so the banning was obviously a direct result of my PRIVATE MESSAGE to Hollenegg.

Maybe he was upset because I mentioned the official complaint filed with the California Bar Association. The complaint addresses all of the updates, letters, predictions & guarantees from Hodges & all his pals since last January.

The 'fluid' information CRAP has been VERY OLD for a VERY LONG TIME...!!
And by the way, it's been almost 1 1/2 YEARS, and Hodges STILL hasn't told us it might take longer than he thought last January...!!

Although some may question them, my motives are clear.
I just want the TRUTH.

Getting PAID one of these YEARS would be nice also.

While I am not one of the lead/named plaintiffs, I am one of the approximately 50,000 shareholders of CMKM Diamonds, who are named as the 'similarly situated'. The case includes language about being/becoming a Bivens class action, in which the shareholders would be the 'class', represented by Mr. Hodges.
This case was filed back in January/2010. It has been dismissed twice, and is currently under appeal.

My complaint is centered on the fact that since last January, Mr. Hodges and/or his assistant Mr. Dennis Smith, have repeatedly posted updates on public message boards for all CMKM shareholders.

Mr. Hodges is 'alch11', and Mr. Smith is 'particleswaves', on these boards.

Fellow Travelers,

As most of you probably know, Al and I were individual shareholders long before Hodges and Associates legally entered the fray. Accordingly, we are painfully aware that this continues to be an agonizing slog for all concerned. Please be aware that we want this totally resolved (now) as much as anyone and are unconditionally committed to effectuating total resolution.

Addressing the “We’ve won” post from Al, I think it reasonable, fair and safe to say we had significant input (and impact) in what turned out to be a giant “money war” that on one side included (but was not limited to) individuals and issues attendant to CMKM and on the other a macabre and malignant collection of powerful individuals and entities rotten to the core. Al, extremely well-positioned in all this, is firmly convinced that the large war is essentially “won”, and that we’re now simply (or not so simply) waiting for the spoils of war to trickle down to the troops. If the trickle down process seems agonizingly slow it’s because it has proven to be exactly that, i.e., a much slower final process than we were led to anticipate.

It has fallen to me to field the plethora of daily calls and emails re CMKM directed at the office, subsequently playing 20 questions with shareholders (some desperately) seeking clarification, more information, reassurance, certainty on when and how much, comments on who said (or didn’t day) what when or why and all the rest of it. I understand the frustration because as a shareholder I’m frustrated too. Please understand however I don’t always have the time or inclination to get back to everyone (particularly repeat callers) promptly; it’s always my intention and I typically take calls and/or get back to most shareholders without ado but it doesn’t always happen and I know there are some who have made overtures to the office that I have let fall through the cracks altogether. To you I sincerely apologize. I do not however apologize to those who I deliberately ignore (or tell to stick it) who approach the office with entitlement “demands” and/or with an “attitude”. Often I do not (and will not) respond to ingrates. Most callers, I hasten to add, are not “ingrates” with an “attitude”, but are in fact just the opposite, i.e., really good people who share this dream. Unfortunately a disturbing number of those “really good people” have heart-wrenching stories and are in varying degrees of financial difficulty. While it breaks our heart that so many shareholders are on the financial (and emotional) edge, please know there is nothing either we or you can do to speed up the process. I wish we had a magic wand to wave but we don’t control the wind, all we can do is adjust our sails. We WILL persevere and we WILL prevail, however we just can’t say with absolute certitude (at least at this moment) exactly when money will hit everyone’s pockets. It could be tomorrow, the next day, next week, next month or (the gods forbid) some longer time; Murphy’s Law and the Law of Unintended Consequence are unfortunate facts of life so we might adjust our immediate expectations accordingly.

Just for the record, and particularly to those who have lately (or not so lately) disparaged our efforts, you should know that Al Hodges has personally borne the lion’s share of the considerable expenditure(s) of time and money attendant to the litigation undertaken on behalf of all shareholders. Al is irrevocably committed to bringing this matter to a successful conclusion and continues to work tirelessly toward that end. Additionally, It might be instructive to know that he has not asked for nor has he taken one dime from shareholders, apart from an initial (and quite modest) retainer received from less than a handful of our lead plaintiffs.

All of which, you may ask, leaves us exactly where? Without going into specifics, here’s the take-away. In our considered opinion this saga will probably resolve with everyone “getting paid” erelong (how’s that for a word because it’s already past “soon”) but the operative words are “probably” and “erelong”. Expect and hope for the best but it’s prudent to remember that there are no absolute guarantees in this life, so while you are expecting and hoping for the best you might consider preparing for the worst on the off-chance that despite our “winning” the war the disparate “Big Boys” that remain standing could conceivably continue to drag out turning over the spoils.

Hope all this helps clear the general air, even a little. Keep the faith and good luck to all of us. I reiterate, we WILL persevere and we WILL prevail.

Why isn't the news media covering a $3.87 Trillion Dollar lawsuit
against past & present officials of the Securities & Exchange Commission?

A lawsuit trying to recover funds for thousands of shareholders,
who's company was used in a government sting operation against
some very bad people on Wall Street.

According to court documents, it involves some well known officials & lawyers, and a settlement negotiated by the late Mr. Robert Maheu, of Howard Hughes fame.

Nothing on CNN or FOX or CNBC or Bloomberg...
Not in Cavuto's World...
No Mad Money rant by Cramer.

Why are the details of this lawsuit being concealed from the general public?
Why is coverage of this lawsuit being censored?

There is an CNN iReport about this lawsuit with over 10,000 views, but CNN has not chosen to investigate the story.
At the very least, this is the kind of story that would get ridiculed
in the last minute of a news broadcast...

2. Tramp understands very well what’s been going on; he is not alone – Pixie gets it, Deltadon gets it, Chucky gets it, etc. etc. etc.

3. I understand that you may not be happy with what’s going on. However, it is a fact and we are only a very small part of the pay-out scheme. We have had a great deal of ‘headwind’ in the past 6 to 9 months. Unfortunately that is putting it altogether too mildly. We have confronted, with added pressure from the “lien-holders” without which we could not have succeeded, the vilest, most contemptible, well financed forces for evil on the planet – we have won! A life changing event it will be for CMKX shareholders; more importantly, the world financial markets will be essentially re-constituted from the currency level up.

4. To put it another way, the World Global Settlements, including the US Dollar Refunding Project, are real. They are the instruments of change. They are part of a world wide re-distribution of wealth which includes some 20 countries revaluation [up and down] of their currency, which will become asset-backed currency. Yes, this does include Iraq which is the cheapest of the lot and therefore had [to prevent unreasonable manipulation] to go first. The very latest information indicates that it has revalued, that it will be posted on Forex sites sometime on Sunday, and will be fully convertible in the US by Tuesday.

5. Although CMKX payments were not originally part of the WGS, they were included by attachment earlier this year. However, be assured that CMKX moneys are not currently part of the WGS; I understand from a number of different sources that Global Intelligence of Las Vegas petitioned the US Supreme Court, in camera, just after Christmas to separate CMKX pay-outs from any association or attachment with the WGS. I understand further that the Court issued an Order for the Trustees to pay-out the moneys within 48 hours, which time expired on or before December 31, 2010. I have received further information that Global Intelligence has not effected said pay-outs, has been fined some $150,000,000 on or about January 4, 2011, and is presently incurring additional fines at the rate of $13,000,000 per week. I have not been successful in any of my attempts to secure explanation from Global Intelligence.

6. Although at first blush this lack of performance may seem potentially criminal in nature, I believe there is a reasonable explanation. I am aware, for example, that many of those I have previously referred to as ‘miscreants’ have in the interim been duly relieved of the money they stole [which has now been recovered by the US], are still feared by the new-financial-order people; the fear is that to the extent they can obtain cash/financing, they would use the IQD revaluation as a means of replenishing their war chests. There are other reasons related to the big picture, which may also play a part in this delay. I know this will come as a shock to some and seems unfair on the surface, but the fact is that we are but a small part of what’s happening [and must happen] to correct the financial imbalance in the world.

7. Several months ago, due to the on-going delays and increased ‘headwind’ the Joint Chiefs of Staff were appointed by the World Court to supervise the conclusion of the WGS; they were given a deadline of December 31, 2010. Based upon this and the progress that was being made in early December, I opined [which has been widely reported] that if I were a betting man CMKX would be paid out by Christmas. Unfortunately, not even the JCS were up to the task. Accordingly, on January 1, 2011 the World Court appointed one of the lien holders, China, to take charge and supervise the conclusion of the WGS payouts. They are currently in charge and proceeding to bring the matter to conclusion. I am currently advised that all will be completed by January 21, 2011.

8. Prior to the recent change of process by the Chinese lien holder it was a requirement, based upon BASEL, that ER be obtained prior to the time that certain other payments could be made. As I have previously stated on many occasions we were waiting for Michael Cottrell and his companies to receive their payments as they were Number 20, the very last payee, on the BASEL list. Because the Chinese lien holder has changed the process, I now understand that Michael Cottrell will be paid on or about January 21, 2011, after all of the Prosperity Program money has been paid out which is estimated to take between 4 – 5 days. This is no way suggests that ER continues to be a requirement of the release of CMKX payments. As set forth above, I have tried desperately to contact Global Intelligence to secure their agreement to authorize immediate release of the CMKX packages, as I believe that the reason for delaying their delivery has now evaporated.

9. I have been told by three separate independent people, each of whom attest that they have personally viewed at least one package, that the CMKX packages contain written information as well as a preliminary payment in the form of a U.S. Treasury Check in the amount of $0.80 per share. The information that has been previously placed on the boards to the effect that the packages were prepared and were ready for distribution is accurate to the best of my information, knowledge and belief. I further understand that the packages remain ready for immediate distribution as soon as Global Intelligence determines, and/or is advised, that such distribution is approved.

10. Some have inquired whether registration with the Transfer Agent makes them a bona fide shareholder; in a word – YES. Some have asked whether I have had response to the letters which I have submitted to the Queen of England and others including POTUS; I have had direct response from the Palace and have seen rapid evidence of the efficacy of the other correspondence that has been submitted. Others have requested information regarding the identity and whereabouts of the CMKX Trustee and/or Trustees. This information can not be made public at the present time for security reasons; I am sure that you will hear more about this in the very near future.

Editor's Note - I wasn't expecting to get paid tonight, but I was hoping for some real facts, not a recap of all the rumors we've heard.
Past history of the last year shows that Hodges' word is meaningless concerning what he thinks will happen. JMO.

If you believe all the stories we've heard, it would be a pretty good update...
Unfortunately, we have no proof that ANY of those things are really happening. JMO.

Mr. Smith & Mr. Hodges,

If the shareholders knickers are twisted, it is because of your apparent disregard for the plight of the shareholders...
Some of whom have been waiting for this for more than 8 years.

A message to shareholders is a step in the right direction, but any official update will need to be full of facts and time frames for what is happening & expected.

Shareholders will not get untwisted by another useless update telling us payment is imminent and everything is nearing completion.

I doubt that any shareholder questions your efforts and hard work in trying to secure our funds.
However, the visible result of this is a twice dismissed lawsuit, rumors of every shape & size, and not one shred of evidence of any real progress.

In spite of all this, I hope that you can finally tell shareholders that this is really finally done, and be able to support that with some real hard facts.
